1. Overview

Welcome to A Darker Season Awaits. In these Terms, “we,” “us,” and “our” refer to Abundant Honey Advertising LLC, which operates A Darker Season Awaits (the “Store”). These Terms govern access to our website and related products, content, tools, and services (the “Services”). Our store is powered by Shopify. By using the Services, you agree to these Terms. Our Privacy Policy explains how we handle personal information. If you do not agree to these Terms, do not use the Services.

2. Access and accounts

You must be legally able to enter into a binding agreement to place an order. Any use by minors must be supervised and authorized by a parent or guardian. Provide accurate, current contact, billing, shipping, and payment information. Keep account credentials secure and notify us of suspected unauthorized use. You may not sell or transfer your account.

3. Products

We aim to describe and display our products accurately. Colors and appearance may vary by screen and device. Check the product description, size information, and selected options before ordering. We may change future product offerings or limit quantities, subject to applicable law. These statements do not limit statutory rights relating to goods that are defective or not as described.

4. Orders

An order is an offer to purchase. We may decline or cancel an order for reasons such as unavailability, suspected fraud, or an obvious pricing error, subject to applicable law. If an order is declined or cancelled after payment, we will refund amounts paid for the cancelled items. We will contact you using the details provided if a material change is needed. Contact us promptly to request a cancellation or correction; we may be unable to change an order once production or fulfillment begins. Returns are governed by our Refund Policy and applicable law.

5. Prices and payment

The price applicable to your order is displayed before you submit it. Taxes, shipping, and other applicable charges are shown at checkout where calculated or collected. Promotions may have separate terms. You must be authorized to use the payment method you provide. Price changes apply to future purchases; we will not charge an additional amount for an existing order without your authorization.

6. Shipping and delivery

Products are printed to order and normally produced and prepared for shipment within 3 business days after payment confirmation. Delivery estimates and available methods appear at checkout. If shipment cannot be made within the promised time, we will contact you about a revised date and your cancellation and refund options. See our Shipping Policy. Nothing in these Terms removes remedies required by law for delayed, missing, damaged, or incorrectly supplied goods.

7. Intellectual property

The Services and their content, including names, logos, designs, text, images, graphics, and other materials, belong to the Store or their respective owners and licensors. You may use the Services for personal, lawful shopping and browsing. Except where permitted by law or authorized in writing, you may not reproduce, distribute, commercially exploit, or create derivative works from protected content. Shopify and third-party marks remain the property of their respective owners.

8. Third-party tools and links

The Services may provide access to third-party tools or websites. Those providers have their own terms and privacy practices. Review them before using their services. We do not control third-party websites and do not endorse all content on them merely by linking to them. Any exclusions of responsibility apply only to the extent permitted by law.

9. Relationship with Shopify

A Darker Season Awaits is powered by Shopify, which enables us to provide the Services to you. Sales through this Store are made with the Store, not Shopify. Shopify is not the seller of our products. To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, losses, or liabilities arising from your purchases from the Store.

10. Privacy

Personal information is handled as described in our Privacy Policy. Shopify also processes data to provide and improve its services, as described in its privacy policies. Our Your Privacy Choices page explains applicable opt-out choices. A privacy notice does not replace any consent required by law.

11. Feedback and reviews

If you submit reviews, suggestions, or other content, you represent that you have the rights needed to submit it and that it is accurate and lawful. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and adapt that content to operate and promote the Services, subject to applicable law and our Privacy Policy. Disclose any incentive received for a review. Do not submit unlawful, misleading, infringing, abusive, or malicious content. We may remove content that violates these Terms; this does not restrict lawful, honest consumer reviews.

12. Errors and corrections

We may correct errors in product information, pricing, offers, shipping charges, or availability. If an error materially affects an existing order, we will notify you and provide any cancellation, refund, or other rights required by law.

13. Prohibited uses

Use the Services lawfully. Do not commit fraud, impersonate others, infringe intellectual property, harass others, distribute malware, collect personal information without authorization, send spam, or interfere with the Services. Do not bypass access restrictions, security controls, or other protective measures. Unauthorized automated extraction or use that disrupts the Services is prohibited.

14. Automated agents

If you use an automated shopping agent, you remain responsible for actions you authorize. Agents must identify themselves truthfully when asked, respect access restrictions, and not bypass CAPTCHAs or security controls. We may limit automated access that threatens security or availability. These Terms do not authorize an agent to place an order or accept additional commitments without its user's authorization.

15. Suspension and termination

We may restrict or terminate access for violations of these Terms, fraud, or security risks, subject to applicable law. Termination does not eliminate payment obligations already incurred, refund obligations, or rights that by their nature survive termination.

16. Warranties

To the extent permitted by law, the website and optional tools are provided as available, without a guarantee of uninterrupted or error-free operation. Any implied warranties are excluded only where exclusion is lawful. Nothing in these Terms excludes an express product promise or any non-excludable warranty, guarantee, or consumer right.

17. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, or consequential losses, such as loss of profits or data, arising from use of the Services. Nothing excludes or limits liability that cannot lawfully be excluded or limited, including applicable liability for fraud, willful misconduct, or personal injury, or your mandatory rights as a consumer.

18. Indemnification

To the extent permitted by law, you agree to indemnify the Store and its service providers for reasonable third-party claims resulting from your unlawful use of the Services, infringement of another person's rights, or material breach of these Terms. This does not apply to losses caused by the indemnified party's own unlawful conduct or override mandatory consumer protections.

19. Severability and waiver

If a provision is unenforceable, the remaining provisions continue to apply. A failure or delay in enforcing a provision does not waive the right to enforce it later.

20. Entire agreement and assignment

These Terms and the policies incorporated by reference govern use of the Services and purchases from the Store, subject to any express terms agreed for a particular transaction. You may not transfer your obligations without our consent. Any transfer of our rights or obligations remains subject to applicable law and will not remove your mandatory protections.

21. Governing law

These Terms are governed by the laws of Oregon, United States, except to the extent mandatory laws in your place of residence provide otherwise. Where permitted by applicable law, disputes may be brought in courts serving Lincoln County, Oregon. This clause does not deprive consumers of any mandatory right to bring proceedings in another court.

22. Changes to these Terms

We may update these Terms by publishing a revised version and its effective date. Material changes will be communicated where required by law. Changes will not retroactively remove rights arising from an existing order. Review the current Terms before placing a new order.
